![]() This case, unfortunately, is true. Beggs v. Kmart Corp. (no cite available. Case decided on April 8, 1998). The jury took just two hours to determine that defendant Kmart Corp. was not liable. Some people may recognize the young soda fan as the winner of a Darwin Award. The Award is issued annually to those people who have killed themselves in the most ridiculous manner possible, thus effectively removing themselves from the gene pool. A sample from their web site, the 1992 winner: "Ken Charles Barger, 47, accidentally shot himself to death in December in Newton, NC, when, awakening to the sound of a ringing telephone beside his bed, he reached for the phone but grabbed instead a Smith & Wesson .38 Special, which discharged when he drew it to his ear." |
